1 | The CB-CID Police, Tirunelveii has registered a First Information Report in Crime No. 1/2015 under Section 174 of the Code of Criminal Procedure on the basis of the complaint made by Smt. S. Saraswathi to the railway police regarding the death of her husband late S. Muthukumarasamy who was working as Assistant Executive Engineer, Agriculture Department, State of Tamil Nadu who met with an untimely death in a train accident being hit by Dhadar Express near Thachanallur railway gate, Tirunelveli District on 20.02.2015. Subsequently the First Information Report was altered to Section 120(B), 306 of the Indian Penal Code and Section 7 of the Prevention of Corruption Code, 1988. In the final report filed by the CB-CID before the Judicial Magistrate, Tirunelveli, I and two others were added as accused in utter lack of jurisdiction for offences under Section 120(8) of the Indian Penal Code r/w. Section 7 of the Prevention of Corruption Act, 1988 r/w. Section 109 of the Indian Penal Code and Section 306 of the Indian Penal Code r/w. Section 34 of the Indian Penal Code and the same was numbered as P.R.C. No. 40/2015. A Crl.O.P.(MD) No.22379/2015 was filed by me under Section 482 of the Code of Criminal Procedure before the Madurai Bench of the Madras High Court and the P.R.C. No.40/2015 pending before the Judicial Magistrate, Tirunelveli was consequently quashed by an order dt.08.03.2016. Thus the charge sheet and summons in so far as it relates to me with regard to offences punishable under Section 120(8), Section 306 of the Indian Penal Code and Section 7 of the Prevention of Corruption Code, 1988 were quashed. However the State represented by the Deputy Superintendent of Police has preferred SLP No.2688/2016 before the Honble Supreme Court challenging the order dt.08.03.2016 of the Madurai Bench of the Madras High Court in Crl.O.P. No.22379/2015 and the SLP has been converted as Criminal Appeal No.000322/2017 and the same is pending. | No | No |
